With experience spanning across different sectors of the infrastructure and construction industry, we have the skills and understanding to provide strategic advice to clients at various stages of project implementation.

We advise our clients on various aspects relating to infrastructure and construction laws. Our advise ranges from drafting of tenders and project documentation to the resolution of disputes arising out of projects.
Our approach is a holistic one, spanning project development, contract administration and dispute resolution advice. We possess a dedicated team of lawyers who are highly experienced in advising on both project development and dispute resolution, giving them a unique understanding of the full life cycle of projects.

We structure and negotiate all major forms of construction contracts, as well as bespoke contracts and ancillary documents, including engineering procurement and construction (EPC) contracts, operations & maintenance contracts, concession agreements, financing contracts, joint venture agreements, technical service agreements, and licensing agreements. Based on our experience, we assist our clients in building custom solutions by structuring the contract forms that are made commercially and financially appropriate.

Our attorneys have experience with project execution-related issues. We help our clients by advising on the requirements of diverse approvals and assisting in obtaining them. We also act as legal advisers on environmental issues and other compliance issues.

Archeus has advised diverse clients in the energy sector and the portfolio of power projects being handled by the Firm exceeds, in aggregate, 20,000 MWs including, more than 3,000 MWs of greenfield power generation projects. Further, we have a strong portfolio of metro, rapid rail transport, roadways and bridge projects that are currently in different stages of development.

INDICATIVE CREDENTIALS

Advising a state-owned road development undertaking as its principal legal advisor on its various PPP/turnkey roads and bridges projects.

Advising a state-owned bridge development undertaking in relation to major river bridge construction projects across river Ganga connecting NH-19 to NH-30 in the state of Bihar.

Project advisory services to a concessionaire involved in the development and construction of a 50.65km 4-lane national highway expansion project in eastern India, including advising the client with regard to the claims of both the Central and State Governments under two separate agreements. The advise takes into account a wide gamut of laws, to ensure that both parties can be jointly and severally held liable.

Advising a concessionaire involved in implementation of four-laning of approximately 150 kms of national highway in central India. Our team is advising the client on various types of claims and maintainability against the central government authority including claims relating to loss of revenues caused due to the economic downturn faced by the Project.

Legal Advisory services to a leading project and technology PRC entity involved in providing environmental solutions to power plants, for their ongoing and prospective projects in India. The principal scope of work is to provide project advisory and contract management support on day-to-day legal and commercial issues arising under EPC contracts, structuring and evaluating bids for sub-contracting various specialized works, other ancillary areas such as technical specifications and labour, and advising on bids with respect to power projects in India.

Advised a leading Chinese state-owned power construction company, in relation to their operations and maintenance contract with the developer of a thermal power plant project in the state of Punjab, India.

 

Advisory and documentation support to a leading European company specializing in development of hydro power plants, relating to contracts for electro-mechanical works with respect to a hydro power project in northern India, as well as for a thermal power plant in southern India.

 

Advised a leading Chinese real estate major listed on the Hong Kong Stock Exchange, with respect to their real estate investments in India. The advisory involved due diligence on proposed assets and target companies in India and providing advice on legal and regulatory aspects under Indian laws.

Advising PRC companies with respect to conducting an analysis of legal and regulatory framework in India and developing a structure for their entry strategy to India.

 

Developed strategies and provided pre-dispute advisory services to a leading PRC power plant construction company, under issues arising out of execution of the main EPC Contract with respect to a thermal power project being developed in Central India.

 

Developed strategies and provided pre-dispute advisory services to a leading international power plant construction company, under issues arising out of execution of the main EPC Contract with respect to a thermal power project being developed in Eastern India. The key issues involved in the matter included the interpretation of the provisions of the EPC Contract vis-à-vis the statutory provisions under electricity laws and associated laws with respect to evacuation of power.

Advising a state undertaking regarding pre-dispute strategies against the Contractor in a project for Construction of a bridge over the river Ganga in eastern India. The nature of disputes in the project mainly relates to escalation, price variation, change of scope orders, Liquidated Damages, delay in completion, idling, etc.
